Wills and Estate While you may find it challenging to decide what you should leave behind and who should be entitled to your possessions after your passing, it’s always a better idea to make such preparations beforehand for inevitable circumstances. It’s no surprise that an individual’s death can result in emotional and financial burdens among their family members and loved ones. Furthermore, it can even increase their legal obligations. However, written instructions in the form of wills can be of great help. Your will and estate distribution will be just as thorough and streamlined as detailed and specific your plan is. At VMOST we can assist you in such matters. Last Will and Testament - Your Last Will and Testament is a legal document that outlines how your assets should be divided and your estate should be dealt with upon your death. It lets you decide who receives your property and possessions and name a trustee (or executor) to manage your final affairs giving you the assurance that your final wishes will be carried out as you intended. Health Care Directive / Living Will - A Power of Attorney for Personal Care gives an individual you trust the legal authority to make medical and long-term care decisions for you when you are unable to do so. This can include things such as your meals, housing, hygiene, nutrition, or anything else pertaining to your health and well-being. Power of AttorneyP.O.A. (Continuing) A Will can only become valid once you pass away. For instances where you become unable to make vital decisions or understand its consequences because of an illness, injury, or age, VMOST Law will draft you a Power of Attorney (POA). It is a document you draft voluntarily with the help of our Wills and Estate lawyers. A POA gives others legal authority to act on your behalf when you are unable to care for yourself or want help because of age or infirmity. P.O.A. (Property) A Power of Attorney for Property gives an individual you trust the legal authority to make decisions about your assets if you are unable to. This can include things such as paying off your debt and bills, collecting money owed to you, or managing your real estate. Probate Without a Will - When a friend or loved one dies intestate without a Will, their real property and personal possessions are distributed to specific beneficiaries, regardless of what their last wishes may have been. A probate allows you to act as the personal representative or executor (also called estate trustee) for an Ontario resident. Probate With a Will - As an Estate Trustee, you will need to apply to the Ontario Superior Court of Justice to get court authorization to act on the deceased’s behalf. A probate certificate allows you to access financial accounts, settle debts, pay final income taxes, and use the deceased’s assets to pay mortgages and other estate expenses. At VMOST we help you to prepare sworn and notarized affidavits to make court applications for a certificate of appointment as an estate trustee with a Will. We give you practical legal advice at affordable fees or referrals to services that can assist you. We answer all your questions to make administering a final estate easier.
